Oracle Technology Network License Agreement

IMPORTANT: READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING, INSTALLING, OR USING ANY PART OF THE SOFTWARE, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU ARE AGREEING TO THIS LICENSE ON BEHALF OF AN ENTITY, YOU REPRESENT THAT YOU HAVE AUTHORITY TO BIND THAT ENTITY. IF YOU DO NOT AGREE TO ALL OF THE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

This Oracle Technology Network License Agreement ("Agreement") is between you ("You") and Oracle America, Inc. ("Oracle") for use of the Oracle Java SE Development Kit, Java SE Runtime Environment, and JavaFX Software, including any updates thereto (collectively, "Programs"), provided by Oracle under this Agreement.

1. Grant of License

Subject to the terms of this Agreement, Oracle grants You a non-exclusive, non-transferable, limited license to use the Programs solely for the following purposes:

Personal Use: You may use the Programs for personal, non-commercial use including desktop or laptop installations for individual development, testing, prototyping, and demonstrating Your applications.
Development Use: You may use the Programs for purposes of developing, testing, prototyping, and demonstrating Your applications, provided that You do not deploy the Programs in a production environment.
Oracle Approved Product Use: You may use the Programs as part of or in conjunction with an application authorized by Oracle for use with the Programs. A current list of approved products is available at oracle.com/java/technologies/javase-approved-products.html.

2. Restrictions

You may not:

Use the Programs for any data processing or any commercial, production, or internal business purpose other than as expressly permitted in Section 1;
Remove or alter any proprietary notices, labels, or marks on or in copies of the Programs;
Assign, sublicense, sell, resell, lease, rent, or otherwise transfer or convey the Programs or any rights therein to any third party;
Modify, translate, adapt, or create derivative works based upon the Programs except as expressly authorized by Oracle;
Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Programs, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction;
Use the Programs to provide third-party training on the content and/or functionality of the Programs;
Use the Programs on any platform other than a supported platform as identified in the documentation;
Publish the results of benchmark tests run on the Programs without Oracle's prior written consent.

3. Ownership

Oracle and/or its licensors retain all ownership and intellectual property rights in the Programs. The Programs are copyrighted and protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Oracle and/or its licensors retain all right, title, and interest in the Programs and all copies thereof, including all intellectual property rights therein.

4. Third-Party Technology

The Programs may contain or be distributed with third-party technology. Oracle may provide certain notices to You in the Programs' documentation, readmes, or notice files concerning such third-party technology. Third-party technology is licensed to You either under the terms of this Agreement or, if specified in the documentation, readmes, or notice files, under Separate Terms. Your rights to use Separately Licensed Third-Party Technology under Separate Terms are not restricted in any way by this Agreement.

5. Source Code

Programs may contain source code that, unless expressly licensed for other purposes, is provided solely for reference purposes pursuant to the terms of this Agreement. Source code may not be redistributed unless expressly provided for in this Agreement.

6. Export Controls

You agree that U.S. export control laws and other applicable export and import laws govern Your use of the Programs, including technical data. You agree that neither the Programs nor any direct product thereof will be exported, directly or indirectly, in violation of these laws, or will be used for any purpose prohibited by these laws including, without limitation, nuclear, chemical, or biological weapons proliferation, or development of missile technology.

7. Disclaimer of Warranty

THE PROGRAMS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ORACLE FURTHER DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE PROGRAMS AND DOCUMENTATION REMAINS WITH YOU.

8. Limitation of Liability

IN NO EVENT SHALL ORACLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF ORACLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ORACLE'S ENTIRE LIABILITY FOR DAMAGES HEREUNDER SHALL IN NO EVENT EXCEED ONE THOUSAND DOLLARS (U.S. $1,000).

9. Data Collection

The Programs may collect certain technical data about Your system and Java usage as described in the Privacy Policy and Telemetry documentation. By using the Programs, You acknowledge and consent to the collection of such data by Oracle. You may opt out of non-essential data collection by configuring the Java Usage Tracker as described in the documentation.

10. Auto-Update Feature

The Programs include an auto-update feature that may periodically check for and download updates from Oracle servers. By installing the Programs with auto-update enabled, You consent to the Programs connecting to Oracle servers for this purpose. You may disable auto-update through the Java Control Panel or system configuration.

11. No Technical Support

Oracle is not obligated to provide technical support for the Programs under this Agreement. Technical support, if available, may be acquired separately from Oracle under a separate agreement and fees.

12. Audit Rights

Oracle may audit Your use of the Programs. You agree to cooperate with Oracle's audit and provide reasonable assistance and access to information. You agree to pay within 30 days of written notification any fees applicable to Your use of the Programs in excess of Your license rights. If You do not pay, Oracle may end Your technical support, licenses, and/or this Agreement.

13. Termination

This Agreement is effective until terminated. You may terminate this Agreement at any time by ceasing use of all Programs and destroying all copies in Your possession. Oracle may terminate this Agreement immediately if You breach any term herein. Upon termination, You shall cease all use of the Programs and destroy all copies thereof.

14. Entire Agreement

You agree that this Agreement is the complete agreement for the Programs and this Agreement supersedes all prior or contemporaneous agreements or representations, including any clickwrap, shrinkwrap, or similar licenses. If any term of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain effective. This Agreement is governed by the substantive and procedural laws of the State of California, United States of America. You and Oracle agree to submit to the exclusive jurisdiction of, and venue in, the courts of San Francisco or Santa Clara counties in California in any dispute arising out of or relating to this Agreement.
